He is just a terrible actor- so bad in fact that he somehow manages to make clear cut pens look like dives. He has been booked before for simulation (Burnley for one in the cup), the refs pay attention to these sort of things , he has history. Maguire is his own worst enemy. Chris Maguire, Ashley Young, Arjen Robben, Michail Antonio have all been done for simulation and to say it doesn't matter how you go down is rubbish, how many pens have these players won?
