You agree the terms of a contract, which can take plenty of back-and-forth until both parties are happy with it; then you sign it. Once something has been signed, then it's binding. In Davies' case, contrary to what was reported, he clearly hadn't signed anything, and Celtic's last-minute amendment delayed things, allowing Liverpool to sneak in. Similarly, it was reported that Shaw had signed a pre-contract with Celtic, but Bannan's words and Lennon's subsequent change of stance seems to have raised doubts about that. The more I think about it the pre contract is not binding otherwise it would be a signed contract. Very true, Shaw still not played many games at championship level. Scotland has 2 teams who are perhaps prem level.
