Confidentiality is one of the attractions of arbitation over litigation. Usually all proceedings are confidential and even arbitration awards can be kept cofidential,

But in the EFL case its seems not. Here's what EFL APPENDIX 2 - PROCEDURAL RULES says:

20.1 Subject to Rule 20.2, any Applicable Tribunal shall be entitled to publish any judgment, decision or award.

20.4 All evidence given and any other elements of the case record (for example pleadings, documents, correspondence, statements and submissions) shall, subject to Rule 20.1, be confidential.

Can't be correct

There's no

"Hencetoforward"

"Notwithstanding "

or even

"A party of the first part "

It's barely fookin' legal!!!

Another thing to consider is why would the QC advertise a case that he has lost??

Surely if he is showing Case Studies he is only going to select ones that his chambers have successfully defended

More straw clutching......

I had thought that too but looking at the list of cases he includes, to my untrained eye it looks like he's included cases he's lost as well as won.

You can't very well get a points deduction  or relegation that remains confidential lol

How did you end up in League One?

"We could tell you. But then we'd have to kill you "

Derby are using the same bloke, hopefully because he has a recent track record of winning such cases.

The lads at Birmingham speak very highly of him

Good overview of arbitration in sport by our man Nick De Marco here:

https://www.bloomsburyprofessionalonline.com/bpro/viewbprodoc:exportword/$002ffootball_law$002ffootball_law-0024928.xml?t:ac=football_law$002ffootball_law-0024928.xml

He's Nick De Marco, he's one of our own

Unless we lose the case, in which case he's just another fatcat lawyer on the make
