Following a formal investigation into financial information provided by Sheffield Wednesday in relation to the Club’s 2017/18 Profitability and Sustainability (P&S) submission, the EFL has today issued a number of charges relating to alleged breaches of EFL Rules.

Earlier this year the EFL launched an investigation into the Club’s financial submission for the period ending July 2018 under the relevant P&S Rules following the completion of the sale of Hillsborough Stadium.

The EFL has reviewed a large number of documents obtained from the Club as part of this process and concluded there is sufficient evidence to justify issuing charges of Misconduct. The charges are in respect of a number of allegations regarding the process of how and when the stadium was sold and the inclusion of the profits in the 2017/18 accounts.

All charges will be considered by an independent Disciplinary Commission and, if the charges are proven, the Commission can impose any of the sanctions set out in EFL Regulation 92.2.

The EFL Board has previously agreed and communicated with all Championship Clubs a set of sanctioning guidelines, but the Commission, under EFL Regulations, has the ability to invoke a full range of sanctions should the breach be confirmed.

The EFL continues to review the Club’s 2018/19 P&S submissions.

As these matters are now subject to proceedings, the EFL will be making no further comment at this time.

People will defend the club over this and make out the EFL has some sort of agenda against us. 

 

Sorry but we broke the rules and now we will pay for it. Thats what happens when you refuse to sell a player, overspend, waste money and try to bend the rules. 

 

Deep down I knew it was coming. Hopefully its a swift punishment that won't destroy our season.

Shocking management to get into this position. And a complete waste really when you look at what we've actually achieved. 

Makes those 10 points we dropped recently even worse now ffs.

 

May not get deducted yet anyway, we'll see.

Unfortunately I can't see the outcome being anything else other than a points deduction.

 

Probably 9 points as per the Birmingham precedent.

Nine points would put us in 18th level on points with Huddersfield but we have a better goal difference.

100% but the rules are tug.

 

Think we have a decent defence but won't say much on it in case the EFL are monitoring to predict what we may use as defence.

 

Hope people follow that too.

92 Decisions

92.1 The Disciplinary Commission may at any time make a decision, and may make more than one decision at different times on different aspects of the matters to be determined.

92.2 A decision may:

92.2.1 order a party to do or refrain from doing anything;

92.2.2 order a specific performance;

92.2.3 make a declaration on any matter to be determined;

92.2.4 issue a reprimand or warning as to the future conduct of a party;

92.2.5 order the payment of compensation to The League, any Club, any other club, Player or other person;

92.2.6 order a suspension of membership of The League;

92.2.7 order a deduction of points;

92.2.8 impose a financial penalty payable to The League;

92.2.9 recommend expulsion from membership of The League;

92.2.10 order a withdrawal or loss of benefit otherwise available to members of The League e.g. basic award or ladder payment;

92.2.11 impose an embargo on registration of Players;

92.2.12 order any other sanction as the Disciplinary Commission may think fit; and

92.2.13 order that interest be payable on any sums awarded under this Regulation for such period and at such rates as the Disciplinary Commission thinks fit.

92.3 These sanctions may be imposed immediately or may be deferred or suspended for such period and on such terms as the Disciplinary Commission shall decide.

92.4 At any time a Disciplinary Commission may determine (either of its own accord or as a result of representations from a person, Club or club and in any event in its sole discretion) that if the complaint is upheld, it may wish to exercise the power under Regulation 92.2.5 to award compensation.  If the Disciplinary Commission so determines, it shall notify the parties to the proceedings and the potential recipient(s) of this fact. The Disciplinary Commission may then make appropriate directions as to the receipt of evidence of loss from the relevant recipient(s) as well as directions on the receipt of evidence in response from the parties to the proceedings.

92.5 The Disciplinary Commission shall have the power to abridge the time period set out in Regulation 94.3 (time limits for appeal) if there is a compelling reason why the appeal (if any) needs to be concluded expeditiously.

92.6 Any financial sanction and any order for costs shall be paid to The League within 14 days of the date on which the sanction or costs were imposed.  Any compensation shall be paid in accordance with the order of the Disciplinary Commission.
