I think it's risky and wrong but 2 Derby season ticket holders at work have told me today and they're surprised by it too. There has to be a way that teams like Man City and PSG get around these things? If it were that easy for clubs with money to sidestep rules then they'd all be up to it. I'm going to look into the Derby thing a bit more.

In theory yes, in reality probably not. Not knowing the details I would imagine that the company that now owns it has funded the purchase with a loan. The loan will be secured against the stadium, which would therefore make it impossible to gift the stadium back without settling the debt first.
