I would imagine this is because we didn’t make an official complaint to the police about the Lees incident while the Mansfield players decided the opposite

The CPS and Nottinghamshire Police taking the Forestieri case out of football and into the courts is a new one on me - and I'd have expected they'd also be aware of the assault on Tom Lees, given it took part during the alleged Forestieri incident.

 

Bizarre to have dealt with the two incidents so differently - one goes unpunished, the other ends up in court. I'd consider assault just as seriously as racial abuse.

 

I’d consider assault MORE serious than any kind of verbal abuse

Judge It's unlikely that the alleged victim misheard but it's not proven beyond reasonable doubt.

The Press Association are reporting it as:

 

"District Judge Jonathan Taffe ruled at Mansfield Magistrates Court that Mr Pearce may have been mistaken in what he heard as "it was very loud" at the ground."

Wouldn't he be mistaken if he thought he heard it and didn't?

 

Bit surprised by the judge's comments (as reported by the guy I quoted before) to be honest. Seems very much to be saying that he thinks Forestieri said it but it isn't proven. Not sure how he works that out from the evidence presented.

Dan Hayes: Judge says Pearce was unlikely to have been mistaken.

 

Press Association: Judge says Pearce may have been mistaken.
