Birmingham immediate 9 point deduction..does it affect us?

The point of a March submission is to punish those who are about the break the rules and therefore have time to enforce the punishment.

Birmingham had 7 deduction for breaking them and 3 for ignoring the problem with one less for good behaviour (Which is laughable)

 

So if that was case we'd likely be down 6.

 

However, it just smacks of media putting two and two together and no concrete evidence to suggest it would happen.

For the period 15-18 they can't.

 

But they can for period 16-19.

The P&S that they have failed is based on 3 year rolling accounts.

 

Y1 - 2016

Y2 - 2017

Y3 - 2018

 

They have failed this, they have been deducted points. The matter is now closed. Next year is a new matter, the P&S will be based on;

 

Y2 - 2017

Y3 - 2018

Y4 - 2019

 

Seeing as they lost over £39m in 2017 alone, they will more than likely be in breach on the P&S once their accounts have been submitted

Birmingham could release all their players and play people off the street and they'd still be in danger of breaking the rules again for 16-19 because of what they spent in the last 2 seasons. What are Birmingham expected to do, close the gates for a season? Laughable if this is the case!

What? - you mean they decided to dock points from Brum with immediate effect but next season for us, Villa and Frank Lampard's Derby

Birmingham are at home to Derby in fixture 43.

 

This might help us. Brim were in no danger of top six or relegation. They will probably still need points for safety when they host Derby.

24.It is clear from Mr Ren’s evidence and the documents that the Club knew that in entering into the transfer contracts it was running the risk that registration would be refused for the reason which had been given in the email of 2 May. It had been unable to make the forecasted player sales profits of £8.3 million, although it continued to assure the EFL that it would do so. Those profits were highly material to the P&S calculation which had been submitted on 29 March. It was on 10 July that the Club submitted a revised forecast from which it became clear that the aggregated loss would exceed the aggregate threshold in 2017/18 by at least £7 million.

 

37.The Commission is not persuaded that the signing of Pedersen was actually a breach of the applicable rule and this conduct will not be treated as an aggravating factor in this case. However the EFL was correct to state in its letter dated 1 August that the Club’s conduct had not fully embraced the objectives of the P&S Rules. It is evident from the correspondence that the officials of the EFL had been extremely helpful in providing clear guidance as to the effect of the rules on the Club’s finances and transactions, and it is regrettable that the Club did not consult the EFL before signing contracts and proceeded despite the increasingly obvious fact that the Club would fail to keep its expenditure below the permissible limits in the period ending 30 June 2018. The EFL is entitled to assume that a Club will fully comply with any notice given under the rules, but to avoid any lack of clarity in future cases it would be desirable for notice of a decision to refuse registration of players until a club has complied with certain conditions to clearly identify the relevant rule and the effect of the decision.

They're expected to not breach P&S. The whole point is to make it sustainable year after year, rather than spunking money for 2 years to chance promotion and then sucking up an embargo in year 3 and then resetting.

Of course they can as those are the rules.

 

How is it laughable? Don't wanna be punished don't break the rules.

But it happens, and is going to happen to half of this division soon enough.

 

If the same club is going to receive punishment rolled over for basically the same expenditure from the seasons before, then P&S is even more of a joke that I expected.

 

The League will end up with a dozen clubs going through this circle for years.

In a nutshell. There’s every chance that one of us, Derby or Villa will go up via the play-offs and given Bruce’s track record in this regard, I think it will be more than likely be us who will go up and in true Wednesday fashion get well and truly shafted by the authorities? :wacko:
